Terms of Service
Equipped Rentals Inc. | Master Rental Agreement & Terms of Service
This Master Rental Agreement ("Agreement") is entered into by and between Equipped Rentals Inc. ("Company") and the customer or corporate entity renting equipment ("Renter"). By accepting delivery, taking physical possession, or arranging job site pickup of any equipment from Company, Renter agrees to be strictly bound by these Terms of Service.
1. Rental Period, Rates, and Automatic Overage Extensions
- Rental Term: The rental period begins when the equipment leaves the Company’s yard or is delivered to the designated job site, and it ends when the equipment is safely returned to the Company’s yard or successfully retrieved by Company personnel.
-
Returns & Collections:
- Customer Returns: Equipment must be returned to our yard by the exact date and time specified in the rental contract.
- Scheduled Pickups: If Company is collecting equipment from a job site, the equipment must be shut down, clean, ready for transport, and fully accessible at the agreed pickup time.
- Overage Charges: We do not charge flat late fees. If equipment is not returned or ready for pickup at the scheduled time, the rental period will automatically extend. The Renter agrees to pay the standard applicable daily or weekly rate for all overage time until the equipment is returned or successfully retrieved.
- Extension Requests: Renter must notify Company at least 4 hours before the scheduled return/pickup time to request an extension. Approval is subject to inventory availability.
2. Payment Terms & Credit Card on File Policy
- Card on File Required: While Company does not charge an upfront security deposit, a valid credit card must be kept on file for all active contracts.
- Authorized Charges: By initiating a rental, Renter explicitly authorizes Company to charge the card on file for all rental fees, overage rates, refueling fees, cleaning fees, environmental fees, and verified damage or replacement assessments.
- Past Due Balances: Any unpaid balances after the conclusion of the rental term will accrue interest at a rate of 1.5% per month (or the maximum allowed by law), plus any collection or legal fees incurred by Company.
3. Equipment Condition, Fueling, & Maintenance Obligations
- Operating Condition: Equipment will be delivered in good, working order. Renter must return the equipment clean and free of heavy debris, concrete splatter, or excessive mud. A flat cleaning fee of $75.00 will automatically apply if the machine requires professional washdowns.
- Fuel Policy: Equipment is delivered with a full tank of fuel and must be returned or ready for pickup with a full tank. A refueling fee of $6.50 per gallon will be charged to the card on file if Company has to top off the tank.
- Post-Rental Inspection: Company service technicians will perform a comprehensive operational and mechanical inspection within 1 business day of return or pickup to check for hidden structural, mechanical, or electrical damage.
- Daily Maintenance: For multi-day or weekly rentals, Renter is responsible for daily fluid checks (coolant, engine oil, hydraulic fluid), tire pressure monitoring, and basic greasing as detailed in the equipment's operational manual.
4. Permitted Use, Site Control, and Operator Safety
- Qualified Operators: Renter warrants that only individuals who are fully trained, certified, and legally qualified will operate the rented equipment. Renter is responsible for providing all necessary Personal Protective Equipment (PPE).
- Geographic Restrictions: Equipment must remain at the specific job site address listed on the rental contract. Renter shall not move the equipment to another location without explicit, written consent from Company.
- Illegal Use Prohibited: Equipment must be used strictly for its intended manufacturing purpose and in full compliance with federal, state, and local safety regulations (including OSHA guidelines).
5. Damages, Loss, and Theft Liability
- Risk of Loss: Renter assumes all risk of loss, damage, or destruction of the equipment from the moment of possession until it is returned to or collected by Company.
- Accidental Damage vs. Negligence: Normal wear and tear is expected. Renter is fully liable for any damage caused by misuse, overloading, neglect, improper fuel usage, or operation by untrained personnel.
- Repair Reimbursement: If equipment is returned damaged, the card on file will be charged for the full cost of parts and labor required to restore the machine to proper operating condition.
- Theft or Destruction: If equipment is stolen, lost, or damaged beyond economical repair, Renter agrees to pay Company the full replacement value of the equipment, along with continued daily rental rates until the replacement cost is settled in full. Renter must file a police report within 24 hours of any theft.
6. Cancellations and Early Returns
- Early Returns: Renter may return equipment early or request an early pickup; however, no refunds or prorated credits are issued for unused contract time.
- Cancellations: To avoid a cancellation fee, Renter must cancel a scheduled delivery or pickup order at least 12 hours before the scheduled rental start time. Cancellations made inside this 12-hour window are subject to a fee equal to a one-day rental rate.
7. Limitation of Liability & Indemnification
- No Consequential Damages: Company shall not be liable to Renter or any third party for any incidental, indirect, or consequential damages—including lost profits, lost revenue, or job site delays—resulting from the delivery, operation, failure, or delay of the rented equipment.
- Indemnification: Renter agrees to defend, indemnify, and hold harmless Equipped Rentals Inc., its officers, and employees from any claims, lawsuits, damages, or injuries (including death) arising out of the use, misuse, transport, or possession of the equipment during the rental period.
Terms Acceptance & Rental Authorization
BY ACCEPTING DELIVERY OF THE EQUIPMENT, TAKING POSSESSION OF THE EQUIPMENT, OR CREATING A RENTAL ACCOUNT WITH EQUIPPED RENTALS INC., THE RENTER ACKNOWLEDGES AND AGREES THAT THEY HAVE READ, UNDERSTOOD, AND VOLUNTARILY ACCEPT ALL THE TERMS AND CONDITIONS OUTLINED IN THIS AGREEMENT. POSSESSION OF THE EQUIPMENT CONSTITUTES FULL LEGAL ACCEPTANCE AND AUTHORIZATION FOR ALL ASSOCIATED CHARGES, OVERAGES, FEES, AND EXTENSIONS REFERRED TO HEREIN.
